Judiciary: A delay process

Recently I had to attend Calcutta High Court to follow up a few cases. But my experience is very frustrating. A lot of black gown donned people are running here and there, most of them are called as Juniors. It is a horrible experience for a common people like me on the process of settling cases. On any case, a lot of lawyers who fight for their client(s) most of them remains incomplete either adjourned by the Judge or by the mutual adjutment of them. This process continue day after day from the Lower Court (Single Bench) to Division Bench to the Supreme Court. Sometimes it feels like an endless process. Therefore the Judiciary needs a whole reformation to make it more flexible to cater the need of the people who requires it more. I do not how long it will take in this country. Still, it is the positive side that some people at least get justice in the fight against the mighty and rich.

  1. India may be called a democratic and republic country but politicalization has made it more than a lame in every sphere be it administrative, judiciary or legislative. Here the service of the judiciary has reached in such a momentum that the so-called popular maxim ‘It is better late than never’ is what we have to accept forever. There are hundreds of cases pending in all the courts - be it district courts, high courts or at Supreme Court for even decades together to get the justice from the legal Lord. In most of the cases, the punishment is given by the remanding jails not the actual prisons because of the politicalization of each and every issue even if the cases are criminal and crucial in nature for the country. The word ‘Date’ has become a household term here as all most all the cases get innumerable dates to have got justice, helping the group of professional but unethical lawyers to earn unsubstantially. As the lawyers are becoming the unethical traders of this unlawful business, they fail to feel the heart and financial stability of the victims. We, the unfortunate, have to forget the reality that ‘Justice delayed, is justice denied’.

    Our judiciary needs an overall reformation for which a wholehearted effort is required and this can only be done when we will be able to become more honest, realistic and non-political. Her Excellency should be brought to the notice for this utter reform.
